If your education provider reports unsatisfactory attendance or course progress, or you are not enrolled, the Department can consider cancelling your student visa under section 116 for breach of condition 8202. You will first receive a Notice of Intention to Consider Cancellation (NOICC) with a short response period — often only 5 working days if you are in Australia. If the visa is cancelled you may apply to the ART (usually within 28 days), but a cancellation also brings section 48 and a 3-year exclusion period under PIC 4013 into play, so responding to the NOICC properly is the priority.

Condition 8202 — what it requires

  • You must be enrolled in a registered (CRICOS) course, and remain enrolled in a course at the same or higher level than the one your visa was granted for (with limited exceptions).
  • You must maintain satisfactory attendance (for schools and ELICOS/VET providers) and satisfactory course progress as defined by your provider’s policy.
  • Your provider must report a breach to the Department; that report is normally what triggers the NOICC.

Related conditions often cited in the same notice: 8501 (maintain health insurance) and 8516 (continue to meet the visa criteria, including Genuine Student).

The NOICC and your response period

The notice sets out the ground for cancellation, the information the Department relies on, and a response period. For visa holders in Australia the prescribed period is short — commonly 5 working days from when you are taken to have received the notice. Ask for an extension in writing before the deadline if you genuinely need one; it is discretionary.

A strong response typically covers:

  1. Whether the ground is correct. Was the provider’s report accurate? Were you appealing the provider’s decision internally or externally (for example through the Overseas Students Ombudsman)? Attach the correspondence.
  2. Why it happened. Illness, bereavement, financial hardship, a provider closure — with dated evidence.
  3. What has changed. New enrolment (CoE), an intervention strategy signed with the provider, medical clearance.
  4. The discretionary factors. Section 116 cancellation is discretionary. The Department’s policy looks at the purpose of your stay, the extent of the breach and your responsibility for it, the consequences of cancellation for you and any family, Australia’s international obligations, and your general compliance. Address each one.

If the visa is cancelled

  • Review. Cancellations of onshore student visas are generally reviewable by the ART; the letter states the deadline (typically 28 days; 7 days if you are in detention). For student cancellation cases finalised between March and August 2026, the ART finalised half within 1 year 1 month.
  • Your status. You become unlawful when the cancellation takes effect unless you hold another visa. Apply for a Bridging Visa E immediately to remain lawful while you seek review.
  • Section 48. You cannot lodge most new onshore applications while the cancellation stands.
  • PIC 4013. A cancellation under section 116 normally means a 3-year exclusion for many future visas unless compelling or compassionate circumstances justify a waiver.
  • Work and study. A Bridging Visa E usually carries no work rights and you cannot rely on a study condition; plan finances for the review period.

Cancellation reviews at the ART

The Tribunal decides afresh whether a ground for cancellation exists and, if so, whether the visa should be cancelled. Evidence of genuine, continuing study (a new CoE, attendance records since the notice), the reasons for the breach, and the impact of cancellation on you and your family carry real weight. Frequently asked questions

How many days do I have to respond to a student visa NOICC?

The prescribed period for visa holders in Australia is short — often 5 working days from deemed receipt. Your notice states the exact period. Extensions are discretionary.

Can I change provider to fix an 8202 breach?

A new enrolment can be part of a response, but it does not undo a reported breach. The Department will still consider whether cancellation is appropriate, so explain the breach as well as showing the new enrolment.

What happens to my family members’ visas?

Dependants’ student visas are usually cancelled as a consequence of the primary holder’s cancellation. Include the impact on them in your response and any review.

How long after cancellation can I apply again?

PIC 4013 generally imposes a 3-year exclusion for many visa subclasses after a section 116 cancellation, unless waived for compelling or compassionate reasons. Some visas, including partner visas, are not subject to PIC 4013.
