If you are in Australia and planning to apply for a Subclass 407 Training visa, the timing of your application now matters a great deal. Under the 407 visa changes starting on 12 November 2026, applicants generally have to be outside Australia both when they apply and when the visa is granted.
An application made in Australia on or after that date will generally be invalid. It will not be assessed, it will not give you a bridging visa, and there is generally no refusal decision you can take to the Administrative Review Tribunal (ART). This guide explains who is affected, what stays the same, and what to check before you lodge or leave.
Step 1. Understand what the 407 visa changes are
The new rule in one sentence
For applications made on or after 12 November 2026, you must generally be outside Australia when you lodge your 407 application, and still outside Australia when the visa is granted.
Where the change comes from
The rule is set out in the Migration Amendment (Training Visas—Application Requirements) Regulations 2026, registered on 30 October 2026. It changes the requirements for a valid application and the place where you must be at the time of grant.
The Government says the purpose is to stop the 407 visa being used to extend a stay in Australia, sometimes called “visa hopping”. It builds on the 407 sponsorship changes made in March 2026.
Is there an exception?
Only a narrow one. The Minister can name a class of people in a legislative instrument who may still apply and be granted the visa in Australia. At the time of writing, no such class had been announced, so you should not plan around an exception that does not yet exist.
Step 2. Check whether you are affected
People most likely to be affected
- You are in Australia on a student, graduate or other temporary visa and planned to move onto a 407 for workplace training.
- Your employer or training organisation planned to sponsor you for a 407 after 12 November.
- Your earlier 407 application was refused and you were thinking of lodging a fresh one from inside Australia.
People generally not affected
If you validly lodged your 407 application before 12 November 2026, it is generally assessed under the earlier rules. Under those rules, the visa can be granted while you are in or outside Australia, as long as you are not in immigration clearance. People already outside Australia can keep applying as before.
The date and place you lodge now decide whether your 407 application counts at all. An application lodged in Australia from 12 November is generally invalid, even if it seems to go through online.
Step 3. Know what an invalid application means for you
Why “invalid” is worse than “refused”
A refused application has a decision behind it, and a refusal can often be reviewed. An invalid application is treated as if no valid application was made. Generally, that means:
- No assessment of your training, sponsor or nomination.
- No bridging visa from that application.
- No ART review, because there is no refusal decision to review.
The online system may still let you submit and pay. That does not make the application valid.
What applying from outside Australia changes
Bridging visas are for people in Australia, so an application lodged offshore does not give you a bridging visa. If you leave Australia to apply, your current visa may also end or may not let you come back. Check this before you book a flight.
Before and after 12 November 2026
| Point | Applied before 12 Nov 2026 | Applying from 12 Nov 2026 |
|---|---|---|
| Where you can apply | In or outside Australia | Outside Australia only, unless you are in a class named by the Minister |
| Where you must be at grant | In or outside Australia, not in immigration clearance | Outside Australia, unless the exception applied when you lodged |
| Bridging visa while you wait | Generally possible for a valid application made in Australia | Not available for an application made offshore |
| If you lodge in Australia anyway | Not an issue under the old rule | Generally invalid and not assessed |
| If a valid application is refused | Merits review generally available | Merits review generally available |
Step 4. What this does not mean, and what to do next
What the change does not do
- It does not close the 407 visa. Genuine applicants can still apply from outside Australia.
- It does not cancel any 407 visa you already hold.
- It does not change applications lodged before 12 November, which generally stay under the earlier rules.
- It does not remove review rights if a valid 407 application is refused.
A practical process checklist
- Check where you will be on the day you lodge. From 12 November, being in Australia on that day generally makes the application invalid.
- Talk to your sponsor about timing now. Confirm where the sponsorship approval and nomination stand before anyone sets a lodgement date.
- Do not rush an incomplete application just to beat the date. A weak application lodged early can still be refused.
- Check your current visa before you travel. Look at its expiry date and whether leaving Australia ends it or any bridging visa you hold.
- If you lodged before 12 November, keep that application going. Withdrawing it and lodging again later would put you under the new rule.
- If your 407 is refused, check the review deadline straight away. ART time limits are short and strictly applied.
- Get advice before you lodge or leave, not after.
Frequently asked questions
I am in Australia. Can I still apply for a 407 visa?
Generally yes, but only if you validly lodge before 12 November 2026 and meet the other requirements. From 12 November, an application made in Australia will generally be invalid unless you are in a class the Minister has named, and no such class had been announced at the time of writing.
I lodged my 407 before 12 November. Do I have to leave Australia?
Generally no. Applications made before 12 November are assessed under the earlier rules, which allow the visa to be granted while you are in or outside Australia, as long as you are not in immigration clearance. Keep your current visa status in order while you wait.
What happens if I lodge in Australia after 12 November by mistake?
The application will generally be invalid. It will not be assessed, it will not give you a bridging visa, and there is generally no decision to take to the ART. Get advice quickly about your current visa and your other options.
My 407 visa was refused. Can I still seek a review?
Yes, in many cases. Merits review remains available when a valid 407 application is refused. If your application was lodged in Australia before 12 November, a review may now matter more, because a fresh application from inside Australia would generally be invalid.
