820/801 Partner Visa Grant in 3 Months: Successful Case with Sponsor’s Previous Marriage History

Case Summary

Background:

This case involved an onshore partner visa application where the sponsor had a previous marriage history. The main challenge was to adequately demonstrate to the Department that despite the sponsor’s prior marriage, the current relationship with the applicant was genuine and continuing. Such cases typically require more comprehensive evidence to address any potential concerns from the assessing officer.

Taking Over the Case:

Upon accepting the case, we developed a comprehensive documentation strategy:

  1. Comprehensive Relationship Evidence Collection: Systematically organized proof of relationship development, including documentation of how the couple met, cohabitation arrangements, and social activities participation

  2. Transparent Handling of Sponsor’s Marital History: Assisted the sponsor in providing complete divorce legal documents and prepared explanatory materials outlining the timeline between the previous marriage dissolution and the commencement of the current relationship

  3. Financial and Social Relationship Proof: Prepared substantial evidence of financial intermingling, cohabitation documentation, and relationship recognition statements from friends and relatives

  4. Genuineness of Relationship Demonstration: Through detailed relationship statements, demonstrated the authenticity and long-term commitment of the relationship

Successful Outcome:

After a three-month document preparation period, we lodged the subclass 820 partner visa application. The Department completed the assessment within three months of receiving the application, and the client’s subclass 820 temporary partner visa was formally granted on September 8, 2022. The process required no additional documents from the Department.

This case demonstrates our capability in handling partner visa applications involving complex personal histories. Through thorough and well-organized evidence preparation, we achieved successful visa approval even with the sponsor’s previous marriage background.
