820/801 Partner Visa Concurrent Grant: Permanent Residency Achieved Within 6 Months

Case Summary

Background:

This case involved an onshore partner visa applicant in a genuine and continuing relationship with their sponsor. While no specific complexities were highlighted, partner visa applications typically require comprehensive relationship evidence to demonstrate genuineness and continuity, meeting all legislative requirements set by the Department. The concurrent grant of the subclass 801 permanent visa indicated the applicant immediately met all criteria for permanent residency.

Taking Over the Case:

Upon accepting the case, we implemented an efficient and systematic approach:

  1. Comprehensive Pre-lodgement Assessment: Conducted detailed analysis of the client’s circumstances to confirm eligibility for direct grant of the subclass 801 permanent visa, developing corresponding application strategy.

  2. Systematic Organization of Relationship Evidence: Guided the client in preparing complete relationship proof covering financial aspects, nature of household, social context, and nature of commitment, ensuring a clear and compelling evidence trail.

  3. Precise Application Preparation: Ensured all forms were completed accurately and supporting documents were thorough and met requirements, resulting in a complete application package.

  4. Timely Lodgement and Follow-up: Submitted the application promptly upon completion of all preparations and established effective communication channels to ensure smooth processing.

Successful Outcome:

The application was lodged in February 2021. The Department, upon assessment, determined the applicant immediately met permanent residency requirements. The client’s subclass 820 temporary partner visa and subclass 801 permanent visa were granted concurrently on August 6, 2021. The processing time from lodgement to grant was approximately 6 months. The applicant obtained permanent residency directly, bypassing the two-year provisional visa stage.

This case demonstrates our efficient handling of partner visa applications. Through accurate eligibility assessment and comprehensive documentation preparation, we assisted the client in achieving permanent residency status directly within a relatively short timeframe.
