ACT 190 Visa via Small Business Pathway

Case Summary

Background:

Our client, Mr. M, an Accounting Master’s graduate, faced significant hurdles in his migration journey: his 485 visa was expiring, leaving no time to complete a Professional Year (PY); his PTE English scores were initially below competent level; he lacked an age advantage; and had no prior business experience. With the traditional skilled migration path blocked, Mr. M sought our expertise for a solution.

Taking Over the Case:

After a comprehensive assessment, we identified the ACT Small Business Owner Pathway as the ideal strategy for Mr. M. This route could bypass the need for PY and high EOI points, leading directly to a permanent 190 visa. We developed a clear three-phase plan:

  1. Conquering English Requirement: We encouraged and guided Mr. M to focus intensely on PTE preparation. He successfully achieved scores of 65+ in all bands (Competent English) within six months and concurrently obtained a full skills assessment for Accounting.

  2. Business Planning & Establishment: We guided Mr. M through a market research trip to Canberra and assisted him with every step of business establishment, including entity registration, location selection, and business plan development, ensuring full compliance with ACT government requirements.

  3. Meticulous Management & Application: Throughout the one-year business operation, we provided ongoing, project-managed support. Through monthly consultations, we advised him on maintaining crucial business evidence (financial statements, BAS, employment records, etc.) to ensure he met the high-point criteria for the ACT 190 Matrix. The business performed exceptionally, achieving nearly $200k in turnover within the first six months. Upon fulfilling the requirement, we promptly lodged his Matrix and secured an invitation.

Successful Outcome:

One year after lodging the ACT 190 visa application, we were thrilled to receive the news that Mr. M’s visa was granted directly without any Requests for Further Information. Initially only anticipating a 491 visa, he successfully obtained the permanent 190 visa directly, far exceeding his expectations.

Highlight: This case is a prime example of integrating skilled migration knowledge with business migration practice. We helped the client open a successful path through business ownership in a seemingly impossible situation. Through strategic foresight and meticulous ongoing management, we turned the client’s challenges into a successful business outcome, achieving dual success in migration and entrepreneurship.
