Background:

Our client, Ms. Yang, sought immigration advice during the COVID-19 pandemic, with the primary goal of obtaining Australian permanent residency. She faced several challenges: 1. Frequent adjustments to migration policies post-November 2019 resulted in high uncertainty for state nomination invitations; 2. While she had an accounting background, we identified that she had accumulated over a year of work experience as a Marketing Specialist, a more promising pathway; 3. Her graduate visa was set to expire in late 2022, requiring a compliant bridging strategy to remain in Australia lawfully, maintain full-time work rights, and await a 190 visa opportunity.

Taking Over the Case:

Strategic Skills Assessment: Instead of pursuing the conventional accounting skills assessment path, we recommended she proceed with a skills assessment for Marketing Specialist based on her actual job duties.   3. Seamless Visa Bridging Strategy: Facing her visa expiry, we opted for a subclass 408 COVID-19 Pandemic visa instead of a more costly student visa. This cost-effective solution allowed her to maintain full-time work rights, enabling her to continue gaining relevant experience while awaiting a state invitation.

  4. Contingency Planning & Vigilant Monitoring: We prepared an employer-sponsored visa pathway as a backup option and initiated preliminary discussions with her employer to ensure preparedness for any policy shifts. Throughout the process, we closely monitored NSW nomination policies, ensuring her EOI was always optimised for the best chance of success.

Successful Outcome:

Our persistent and precise strategy culminated in success. In late September 2022, Ms. Yang received an invitation for the New South Wales (NSW) subclass 190 visa based on her high points score. We promptly lodged the state nomination application, which was formally approved in November 2022. The visa application was lodged in December 2022. Ultimately, her 190 permanent visa was granted on April 19, 2023, without any requests for further information. The total processing time from visa lodgement to grant was approximately 4 months
