Strategic Pivot Leads to 189 Visa Success After Partner Visa Refusal

Case Summary

Background:

Ms. S initially applied for a Partner visa in Australia. However, due to professional negligence by her previous migration agent, the application was refused, and the case entered the appeals process at the AAT. After a year of waiting for an AAT hearing, cracks began to appear in her relationship due to life pressures. At this critical juncture, while holding a Bridging Visa A, Ms. S contacted our firm seeking new professional advice on her options.

Taking Over the Case:

Upon a comprehensive assessment of her profile, we identified a viable pathway through skilled migration. Ms. S was nearing completion of a Master’s degree in Architecture in Australia and possessed strong English skills. Although her initial EOI score was not competitive at the time of consultation, we advised her to immediately undertake an English test to maximize her points. She achieved an exceptional PTE score equivalent to superior English (IELTS 4×8) after three months of preparation. Concurrently, we recommended she secure relevant professional employment to accumulate work experience. Ms. S proactively found a job in her field before graduation. Facing limited state nomination quotas and policy uncertainty in the previous financial year, her EOI did not receive an immediate invitation. Undeterred, Ms. S continued to excel in her role, eventually securing a full-time employment contract while still on her bridging visa.

Successful Outcome:

Just before the end of the 2024 financial year, a round of invitations for the Subclass 189 visa was released. With a points total of 75, Ms. S received invitations for both the Subclass 189 and 190 visas. She opted to proceed with the Subclass 189 application. Her decision-ready application was lodged and granted in under two months, with no requests for further information, finalizing her journey to Australian permanent residency.
